• “Platform”: the online platform providing access to purchased content and Services.

• “Partner”: any third party involved in the provision of the Services.

ARTICLE 2 – PURPOSE AND ACCEPTANCE OF THE TERMS

2.1 Purpose

These Terms govern the conditions under which the Company provides its Services to Clients, particularly via the Website and associated Platforms.

2.2 Access

The Terms are accessible at any time on the Website.

The online version shall prevail over any other version.

2.3 Acceptance

Validation of an order constitutes full and unconditional acceptance of the Terms.

No special conditions may prevail without the Company’s prior written consent.

2.4 Legal capacity

The Client warrants that they have the legal capacity to contract or are validly represented.

ARTICLE 3 – CHARACTERISTICS OF THE SERVICES

The essential characteristics of each Service are presented on the relevant pages of the Website.

Access to Services

After payment validation, access details are sent by email within a maximum of 24 hours, subject to bank approval.

Language

Services are primarily provided in French.

Updates

Content is provided in the version available at the date of purchase.

Future updates may be offered at an additional cost.

Specific conditions

Certain Services may require a prior interview.

The Company reserves the right to accept or refuse any Client.

ARTICLE 4 – ORDERS

4.1 Ordering process

The Client enters personal and payment information and confirms the order.

4.2 Prices

Prices are expressed in euros, all taxes included (VAT included), unless otherwise stated.

4.3 Installment payments

Installment payments constitute a payment schedule and not a subscription.

The full price remains due.

4.4 Confirmation

An order confirmation email is sent once the order is validated.

ARTICLE 5 – PAYMENT METHODS

Payments are processed via secure third-party providers (Stripe, PayPal).

The Company does not store any banking data.

In the event of a payment incident, the order is cancelled automatically.

ARTICLE 6 – RIGHT OF WITHDRAWAL

6.1 Withdrawal period

The Client has a statutory period of 14 calendar days.

6.2 Exercise

The request must be sent by registered mail to the Company’s address.

6.3 Exceptions

In accordance with the law, the right of withdrawal does not apply in particular to:

• digital content accessed immediately,

• fully performed services,

• dated events,

• professional Clients.

ARTICLE 7 – COMMUNITY SPACES

All community spaces must be used in compliance with the law and respect for others.

The Company reserves the right to moderate or exclude any abusive behavior.

ARTICLE 8 – PERSONAL DATA

The Company complies with the GDPR.

Details are provided in the Privacy Policy available on the Website.

Clients have rights of access, rectification, and deletion of their personal data.

ARTICLE 9 – ACCESS TO THE WEBSITE AND PLATFORM

Access is provided “as is”.

The Company cannot be held liable for interruptions due to maintenance or external causes.

ARTICLE 10 – FORCE MAJEURE

The Company’s liability is suspended in the event of force majeure.

ARTICLE 11 – INTELLECTUAL PROPERTY

ARTICLE 12 – CLIENT REFERENCES AND IMAGE RIGHTS

The Client authorizes the Company to use testimonials, reviews, and images for communication purposes, unless expressly objected to in advance.

ARTICLE 13 – NON-SOLICITATION

Professional Clients agree not to solicit the Company’s contributors for a period of 12 months.

ARTICLE 14 – AMENDMENTS TO THE TERMS

The Company may modify the Terms at any time.

The applicable Terms are those accepted at the time of order.

ARTICLE 15 – LIMITATION OF LIABILITY

The Company’s liability is strictly limited to the amount paid by the Client for the relevant Service.

ARTICLE 16 – APPLICABLE LAW

These Terms are governed by French law.

In the event of translation, only the French version shall prevail.

ARTICLE 17 – DISPUTES

An amicable resolution shall be sought first.

Failing this, the Commercial Court of Montpellier shall have exclusive jurisdiction for disputes involving professional Clients.
